1. Acceptance of Terms

By creating an account or using All My Mascots ("the Service"), you agree to these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

All My Mascots is an AI-powered platform that generates blended mascot images by combining school mascots provided by users. The Service uses multiple AI models for prompt engineering and image generation.

3. AI-Generated Content Disclaimer

All mascot images are generated by artificial intelligence models. You acknowledge that:

• AI outputs may be unexpected, inaccurate, or contain artifacts
• Generated images may resemble existing mascots, logos, or characters
• We make no guarantee of uniqueness, accuracy, or fitness for any purpose
• You are responsible for ensuring your use of generated images complies with applicable laws and third-party rights

4. Training Data Collection

When training mode is active, the Service may present you with multiple image options and record your selection. This preference data is used to improve our AI prompt model via Direct Preference Optimization (DPO). We process this data under the legitimate interest legal basis (GDPR Art. 6(1)(f)).

5. Model Attribution

All My Mascots is built with the following AI technologies:

• Built with Llama — Llama 3.3 70B by Meta (Meta Community License Agreement)
• Built with Qwen — Qwen 2.5 72B by Alibaba Cloud (Apache 2.0 License)
• DeepSeek V3 by DeepSeek (MIT License)
• Flux 2 Klein 9B by Black Forest Labs — image generation (standard mode)
• Flux 2 Klein 4B by Black Forest Labs — image generation (training mode)
• Gemini 2.5 Flash by Google — fallback image generation
• GPT-4o by OpenAI — prompt engineering

"Built with Llama" is used in accordance with the Meta Community License. "Built with Qwen" attribution is provided voluntarily.

6. Age Restriction

You must be at least 13 years old to use the Service. By creating an account, you confirm that you meet this age requirement. We comply with the Children's Online Privacy Protection Act (COPPA) and do not knowingly collect data from children under 13.

7. Third-Party AI Services

The Service relies on third-party AI providers to function. These include OpenAI, OpenRouter, Fal.ai, Replicate, Google, and Supabase. Your use of the Service is also subject to these providers' terms:

• Text prompts (derived from your mascot inputs) are sent to AI providers for processing
• AI providers may have their own data retention policies for API requests
• We do not share your account information or email with AI providers

8. User Content

You retain ownership of the mascot names and school information you provide. Generated images are produced by AI models under their respective output licenses. Flux image outputs are licensed for commercial use. You may use generated images for personal, educational, or non-commercial purposes. For commercial use, verify compatibility with the generating model's output license.

9. Prohibited Use

You agree not to:

• Use the Service to generate harmful, illegal, or offensive content
• Attempt to circumvent rate limits or abuse the generation system
• Use generated images to impersonate real institutions without authorization
• Reverse-engineer, scrape, or extract model weights from the Service
• Share account credentials or transfer credits between accounts

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI-GENERATED CONTENT WILL MEET YOUR EXPECTATIONS. AI MODELS MAY PRODUCE UNEXPECTED, INACCURATE, OR BIASED RESULTS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO DAMAGES FROM AI-GENERATED CONTENT, SERVICE INTERRUPTIONS, OR DATA LOSS.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via a notice on the Service. Continued use after changes constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of the United States. Disputes shall be resolved through good-faith negotiation before pursuing formal legal proceedings.
